Alleged drunk driver faces wrongful death charge in accident

Despite the constant campaigns of awareness creation about the dangers of driving under the influence of alcohol, daily reports of deaths caused by intoxicated drivers leave one to believe that these actions are ineffective. Drivers who choose to disregard their own safety may not consider the threat they pose to other users of Texas roads. It is not uncommon for drunk driving accidents to lead to wrongful death claims.

The Department of Public Safety recently reported a horrifying accident that occurred in Bastrop. They stated that a 26-year-old driver of an SUV was traveling on Highway 71 when she allegedly crashed into the rear of a truck. The impact caused the truck to rear-end an 18-wheeler, causing a fire that engulfed the truck.

The truck driver was trapped in the vehicle, and although witnesses managed to extricate his passenger, the driver could not be saved, and the fire caused his death. His passenger was rushed to a medical center where she is receiving treatment for severe burn injuries. The driver of the SUV was also rescued from her vehicle before she was booked into the county jail, where she is now facing charges of intoxicated manslaughter.

Texas residents who have lost loved ones in car accidents that were caused by the negligence of another driver have the right to pursue recovery of damages that were incurred as the result of the accident. Proper documentation of the negligence, along with successful presentation of a wrongful death claim in a civil court, may bring about a monetary judgment in compensation of burial and funeral expenses. Under certain circumstances, the court may consider additional compensation as deemed appropriate by the laws of Texas.
